Where a potential employee or current employee has a conviction recorded on their DBS, a suitable risk assessment must be in place.

CQC states – Having a criminal conviction does not in itself make a person unsuitable for work in health or social care. If a DBS check discloses a conviction or other relevant information, the employer has to decide whether the person is suitable to be employed in their service. When doing so, they need to assess the potential risks, taking into account the nature of the information, how old it is, its relevance to the activities the person would undertake, and the circumstances and needs of the people using the service.
